Sending Employees from Taiwan to PRC & Major Differences between Taiwan & PRC Labor Laws

It seems to be a trend that more and more companies are sending employees, both expatriates and locals, from Taiwan to PRC. This presentation will introduce what an employer should know about sending employees from Taiwan to PRC and the major differences between Taiwan and PRC labor laws.

  • Have you taken sufficient steps for the company and the employees in compliance with the relevant laws?
  • Have you considered the consequences of such employment relationship among the three parties in a short term and a long term?
  • What is the better legal structure of sending the employees: secondment by Taiwan company or direct hire by PRC company?
  • In particular, have you considered the impact of the newly effective Labor Contract Law of PRC in preparing your employee transfer?

About the Speaker(s)

Ms. Mar has around 18 years' experiences in labor law and litigation. She was the advisor to the CLA and has maintained a good communication with the labor authorities and active participation in law drafting, which enables her to provide practical legal advice and propose creative alternatives for problem-solving. In recent years she has been focusing on China-related practice and helping her Chinese, Taiwanese, US, and European clients to deal with labor issues in China, including the PRC Labor Contract Law.

Payment for Members
